โ What's Legal Right Now (June 2026)
Hemp-Derived Products
All products derived from hemp (cannabis <0.3% ฮ9 THC by dry weight) are legal under the 2018 Farm Bill and NC S.B. 352.
- CBD: Flower, gummies, tinctures, topicals, beverages
- Delta-9 THC: Edibles, seltzers, capsules (<0.3% by weight)
- Delta-8 / Delta-10: Vapes, gummies, tinctures
- THCA: Flower, pre-rolls, concentrates, vapes
Possession Limits
No statutory possession limit for compliant hemp products in NC.
- Carry what you need for personal use
- Keep products in original packaging with labels visible
- Always carry your receipt and COA (Certificate of Analysis)
Age & Purchase Rules
- 21+ to purchase any hemp-derived cannabinoid product
- Valid government-issued photo ID required
- Retailers must verify age at point of sale
- Online orders require age verification at delivery
๐ซ Where You CANNOT Consume
Public Spaces
- Beaches, boardwalks, parks
- Sidewalks, streets, parking lots
- Restaurants, bars, breweries
- Anywhere tobacco smoking is prohibited
Vehicles
- Never consume in a moving vehicle (driver or passenger)
- Open container laws apply to hemp products
- Store sealed products in trunk or locked glovebox
Federal Land
- Cape Hatteras National Seashore
- Wright Brothers National Memorial
- All national parks, forests, and wildlife refuges
- Federal property = federal law applies (cannabis illegal)
Safe consumption: Private rental homes, backyards, and private property with owner permission only.
๐ Travel & Crossing State Lines
Leaving North Carolina
- Virginia: Hemp products legal; medical cannabis program exists
- South Carolina: Hemp legal, but stricter on Delta-8; keep COAs handy
- Tennessee: Hemp legal; similar framework to NC
TSA & Air Travel
- TSA focuses on security threats, not cannabis
- Hemp products (<0.3% ฮ9) technically allowed in carry-on
- Risk: TSA may refer to local law enforcement
- Never fly with flower โ appearance triggers searches
- Edibles/tinctures in original packaging = lower profile
๐ฉ Red Flags When Buying
No COA Available
If a shop cannot show a Certificate of Analysis for a product, do not buy it. No exceptions.
No Brand/Label Info
Mystery packaging, handwritten labels, or "house blends" with no traceable manufacturer.
Claims > 0.3% ฮ9 THC
Any product labeled with ฮ9 THC above 0.3% by weight is non-compliant hemp.
Synthetic Cannabinoids
Avoid "Spice," "K2," or products listing HHC-P, THC-P, THC-O without clear hemp derivation.
โฐ The November 2026 "Total THC" Cliff
What's happening: The USDA's final hemp rule (effective Nov 2026) requires Total THC testing (ฮ9 + THCA ร 0.877) to stay under 0.3%.
What this means for you: Most current THCA flower will test "hot" (illegal) under the new rule. Delta-9 edibles remain compliant if they stay under 0.3% by weight.
Action item: Stock up on compliant edibles. Expect THCA flower availability to change significantly after November 2026.
