The Current Status
Despite years of lobbying and a growing number of residents requesting access, North Carolina has not passed a medical marijuana law in 2026. There is no official "Medical Marijuana Program" (MMP) and no way to apply for a state-sanctioned medical card.
If you see websites offering "NC Medical Marijuana Cards" for a fee, be extremely cautious. These are often fraudulent or refer to programs in neighboring states (like Virginia).
The "Hemp-Derived" Alternative
While the state lacks a medical program, the 2018 Farm Bill continues to protect the sale of hemp-derived cannabinoids. This is why you see shops all over the OBX selling THCA flower, Delta 8, and THCP.
For those who need cannabis for medical reasons, the most common "legal" alternative in NC is THCA flower. Because it only contains trace amounts of Delta 9 THC (under 0.3%), it is legally classified as hemp. When you smoke or vape it, you is effectively using high-potency cannabis.
Medical vs. Hemp-Derived
In a traditional medical program, you'd visit a doctor, get a card, and buy from a state-licensed dispensary. In NC's current environment, the "dispensary" is a hemp shop.
The Risks and Realities
Possession of "traditional" marijuana (that tests over 0.3% Delta 9 THC) remains a crime in NC. However, most shops in the OBX use third-party lab tests (COAs) to prove their product is hemp-derived.
