Under the 2018 Farm Bill, the US government (and NC by extension) defines hemp as any cannabis plant with less than 0.3% Delta-9 THC. This is why you see shops selling flower that looks, smells, and feels like traditional cannabis—it's just that the THC is in the form of THCA (the non-psychoactive precursor), not Delta-9.

Is THCA legal in North Carolina?
Yes. THCA is a precursor to Delta-9 THC. As long as the total Delta-9 THC content remains below 0.3% by weight, it is considered hemp under the 2018 Farm Bill and is legal to possess and sell in NC.
What happens if I am caught with cannabis in OBX?
